Information on processing of personal data

Data protection and confidentiality is of high importance in Nordic Solar A/S (“Nordic Solar” or “we”). This Privacy Notice explains, how Nordic Solar processes the persona data we collect. This Notice also includes information about your rights in relation to our processing of your personal data.

Description of processing

Below is listed the personal data that Nordic Solar collects and processes on you and for what purposes. Furthermore, you will find information about your rights regarding our processing of your personal data.

Shareholders
Until May 2023, Nordic Solar was registered as a self-managed AIF (Alternative Investment Fund) and therefore subject to the Anti-Money Laundering Act, meaning that we as a company were obliged to obtain certain personal data on our shareholders, including CPR number, proof of identity, as well as identifying of purpose and source of funds/source of wealth. We process these personal data based on legal obligations.

After deregistration as a self-managed AIF, Nordic Solar can facilitate contact between existing shareholders who wish to sell shares and existing or potential new shareholders who wish to buy shares. In this context, Nordic Solar collects personal information on potential new shareholders in the form of CPR numbers, proof of identity, and contact information. We process this information based on a legitimate interest, where the purpose is to ensure the security of the identity of the potential buyer referred to the shareholder who wishes to sell.

To ensure that our shareholders are well-informed about their investment, we further collect, and processes contact information on shareholders, including name, address, email, phone no., for the purpose of ongoing communication and shareholder care, including sending out newsletters, invitations to shareholder meetings and general assembly etc. We process these personal data based on legitimate interests.

Recruitment
Nordic Solar processes personal data on candidates for vacant positions, and when receiving unsolicited applications. We only collect and process personal data needed for the recruitment process. This includes, application, CV, contact information, and any other information you have attached. We process these personal data based on legitimate interests.

As part of the recruitment process, we use personality- and/or proficiency tests. The processing hereof is also based on legitimate interests.

Nordic Solar will ask for your consent regarding the collection of references.

If you are hired, as part of the contract agreement, you will receive our Privacy Notice for Employees, which describes how we process personal data on our employees.

Employees’ relatives
As part of our personnel administration and in case of an emergency, where it might be necessary to reach out to a relative of an employee, we process personal data on the relative, including name, phone number and relation type. We receive personal data on relatives from the employee. We process these personal data based on legitimate interests.

Newsletters
If you want to subscribe to Nordic Solar’s newsletter, during the registration process, you will be informed about the processing that takes place. You will also be asked to provide your consent.

Cookies
When you visit our website, personal data is collected using cookies. You can read more on our use of cookies in our Cookie Declaration (https://nordicsolar.eu/en/cookie-declaration/), which can be found at the bottom of our website.

Storage

We store your personal data as long as they are required for the purposes for which they were collected.

Nordic Solar must comply with the storage requirements set out in the Anti-Money Laundering Act. This means that we are obliged to store your personal data as a shareholder for five years after you are no longer a shareholder.

Third parties

Recipients
We treat personal data as confidential and we generally do not disclose your personal data. However, data may be disclosed to external suppliers, including data processors, who are assisting Nordic Solar with operations.

Transfers to third countries
We strive to reduce the transfer of personal data to recipients outside of EU/EEA, and we only transfer your personal data to recipients in third countries when we have a valid basis to transfer it in accordance with the rules of chapter V of the General Data Protection Regulation.

Your rights

Please note that you have the following rights, when we are processing personal data about you:

  • The right of access: You have the right to access the information we process about you.
  • The right to rectification: You have the right to have incorrect information about yourself corrected.
  • The right to erasure (“the right to be forgotten”): In very special cases, you have the right to have your personal data deleted before the deadlines listed above.
  • The right to limitation of processing: In certain situations, you have the right to have the processing of your personal data restricted. The processing will be restricted to storage only.
  • Right to object to processing: You can always object to the processing of your personal data if the processing is based on our legitimate interest.
  • Right to data portability: You have the right to receive the personal data that you have provided to us in a machine-readable format. This right applies to personal data processed only by automated means.
  • Right to withdraw consent: When the lawful basis of a specific processing activity is your consent, you have the right to withdraw your consent at any time. Your withdrawal will not affect the lawfulness of the processing carried out before you withdrew your consent.

Amendments

This Privacy Notice will be updated as a consequence of amendments to legislation or chances in our internal procedures.
